NATURE OF SERVICE & COMPANY OVERVIEW
Archaster Labs (operated by Lehmann Sisters (Org. nr: 925 301 795, Oslo, Norway) is a B2B technology company providing an AI-powered Operating System for regenerative sourcing, compliance, and supply chain risk management.
We deliver our intelligence through two primary methods:
The SaaS Platform: A subscription-based software interface ("The Archaster OS") that provides ongoing, real-time access to our AI reasoning engine, satellite verification tools, and organizational knowledge graph.
Digital Intelligence Assets: Standalone, one-time purchase digital products (such as "Strategic Blueprints," "Risk Audits," and "Intelligence Sprints"). These are standardized, software-generated PDF reports and guides designed for immediate strategic application.
Important Notice: Whether accessed via the SaaS platform or downloaded as a digital report, our services constitute automated data processing and information services. They do not constitute manual consulting, legal counsel, or professional advisory services.
1. Introduction
These terms constitute a legal agreement between you and Archaster Labs ("Archaster," "we," or "us"). Your use of archaster.ai (the "Site") and the services made available on the Site (the "Services") is subject to these Terms of Service (these "Terms"). By using the Site and any of our Services, you:
- Acknowledge that you have read and understood these Terms;
- Agree to be bound by these Terms;
- Agree to our Privacy Policy; and
- Commit to comply with all applicable laws and regulations.
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
We may revise these Terms at any time by posting updated terms on the Site or providing you with notice. Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms.
2. Definitions
When we use the following terms in these Terms, here's what we mean:
- "AI Output" means content, text, recommendations, or other outputs generated by our artificial intelligence systems in response to your queries or inputs.
- "Customer Data" means any content, text, images, files, or other data that you input, upload, submit, or generate through the Services. Customer Data does not include Usage Data or Archaster Materials.
- "Guest User" means a user who accesses the Services without creating an account.
- "Registered User" means a user who has created an account with us.
- "Personally Identifiable Information"* or "PII" means any information that identifies, relates to, describes, or could reasonably be linked to a specific individual.
- "Services" means Archaster AI and all related features, tools, integrations, and support services we make available to you under these Terms.
- "Site" means archaster.ai and any associated domains or subdomains we control.
- "Usage Data" means anonymized, aggregated telemetry, logs, performance data, usage metrics, and other technical data generated by or in connection with your use of the Services. Usage Data does not include Customer Data or PII.
3. Eligibility and Account Registration
3.1 Age Requirement
You may use the Services only if:
- you are at least eighteen (18) years old or the age of majority in your jurisdiction and have the legal capacity to enter into a binding contract. The Services are not intended for individuals under the age of eighteen (18), and we do not knowingly collect or solicit personal data from anyone under this age. If we discover that we have collected personal data from a minor without verifiable parental consent, we will promptly delete that information. If you believe we may have collected such data, please contact us at privacy@archasterlabs.earth.
- OR you are younger than eighteen (18) years old and participate in an organized event under the supervision of adults and facilitators, for which Archaster has been informed in advance to set up accounts and platform policies for secure and safe processing of participant data in a compliant way.
By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of a company or other entity, you further represent that you have authority to bind that entity to these Terms.
3.2 Guest vs. Registered Users
Guest Users: You may use the Services without creating an account, subject to daily query limits. Guest usage is tracked via browser storage. Guest conversations are stored locally in your browser only and are not linked to any account. Guest messages are transmitted to our edge functions for AI processing but are not stored in our database. Clearing your browser data will delete all guest conversations.
Registered Users: By creating an account, you gain access to additional features, including conversation history, saved contexts, and higher query limits. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Intellectual property rights
4. Intellectual Property, Ownership and Licensing
4.1 Our Rights (Archaster Materials)
We (and our licensors) own all rights, title, and interest in and to the Services and Archaster Materials, including all underlying software, infrastructure, technology, databases, APIs, models, algorithms, interfaces, tools, documentation, website designs, text, graphics, and all improvements, modifications, or derivative works of the foregoing.
For the purposes of these Terms:
“Content” means all text, graphics, interfaces, information, and other content made available through the Services.
“Marks” means our trademarks, service marks, logos, and branding used in connection with the Services.
“Archaster Materials” means the Services, the Content, the Marks, and all related technology, designs, and know-how.
Except for the limited license we grant you under these Terms, we reserve all rights in and to the Services and Archaster Materials.
4.2 Your Rights (Customer Data and AI Output)
As between you and us:
Customer Data (data, prompts, uploads, and other content you or your users submit to the Services) remains yours.
Subject to the anonymized and aggregated learning described in Section 6.3, you also own any AI Output generated for you through the Services, to the extent permitted by applicable law and subject to any third-party rights in the underlying models, training data, or outputs.
You are responsible for how you use AI Output, including ensuring that your use complies with applicable law and does not infringe third-party rights.
4.3 Usage Data
We own all Usage Data, meaning anonymized and/or aggregated data and analytics relating to access, usage patterns, and performance of the Services, provided that it does not identify you or your users as specific individuals or organizations. We may use Usage Data for any business purpose as described in Section 6.3.
4.4 Feedback
If you provide us with any feedback, suggestions, ideas, or other information relating to the Services or our business (“Feedback”), you agree that we may use, copy, modify, distribute, publish, or otherwise exploit that Feedback for any purpose, in any form, and through any medium, without restriction or compensation to you. We have no obligation to keep Feedback confidential.
4.5 Your License to Use the Services
Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to:
access and use the Services; and
download or print a copy of any Content to which you have lawfully gained access,
solely for your personal or internal business purposes.
This license does not give you any ownership interest in the Services or Archaster Materials, and all rights not expressly granted are reserved by us and our licensors. This license terminates automatically if you materially breach these Terms or if your account is suspended or terminated for any reason.
4.6 Prohibited Use (Commercial Exploitation)
No part of the Services, Content, or Archaster Materials may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose (for example, reselling our blueprints or derivative works based primarily on them) without our express prior written permission.
4.7 License Restrictions
You agree not to, and not to permit any third party to:
copy, modify, distribute, sell, lease, sublicense, or otherwise exploit the Services or Archaster Materials except as expressly permitted in these Terms;
resell, provide, or make the Services available to any third party on a service bureau, shared, or time-sharing basis;
share your account credentials or allow any unauthorized person to access your account;
reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or algorithms underlying the Services, except to the limited extent that applicable law expressly permits despite this restriction;
bypass, disable, or interfere with any security, usage, rate-limiting, or access controls applied to the Services;
use automated tools (such as bots, scrapers, or crawlers) to access or interact with the Services without our prior written permission;
upload, transmit, or distribute any malicious code, viruses, or other harmful content;
overload, disrupt, or interfere with the normal operation or integrity of the Services or related systems;
use the Services to harass, defame, impersonate, or otherwise harm any individual or organization;
use the Services in violation of any applicable laws, regulations, export controls, or sanctions;
use the Services to generate or disseminate harmful, misleading, unlawful, or infringing content;
misrepresent AI Output as human-generated in contexts where doing so could cause harm, deception, or a material misunderstanding;
rely on AI Output without appropriate review in high-risk or sensitive contexts (including medical, legal, financial, or safety-critical uses), or represent AI Output as professional advice;
extract, reconstruct, or attempt to determine model weights, training data, or system logic underlying the Services;
use the Services, AI Output, or prompts to train, develop, or improve competing AI models or services without our express prior written permission.
5. Purchase of Digital Products & Reports
In addition to the SaaS Platform, we sell standalone digital assets ("Blueprints") and customized reports ("Assessments"). The following terms apply specifically to these purchases:
5.1 Nature of Digital Products
Blueprints: These are static digital downloads. You are purchasing a non-exclusive, non-transferable license to use the content for internal business purposes. You may not resell, republish, or distribute these files.
AI Reports: These are customized data files generated based on your inputs. They are provided "as is" for decision support and do not constitute professional consulting or legal advice.
Data Handling: These reports operate on a "Process & Purge" basis. To ensure maximum security for your trade secrets, Archaster Labs does not retain your submitted data after the report is delivered. You are responsible for saving your own copy of the final report.
5.2 Delivery Policy
Instant Downloads: Delivered via email link immediately upon successful payment.
Custom Reports/Assessments: Delivered via email within ~72 business hours of successful data submission.
5.3 Refund Policy (Strict)
Due to the digital nature of these products:
All sales of Blueprints and Reports/Assessments are final.
We do not offer refunds once the download link has been sent or the data processing has begun.
By completing a purchase, you acknowledge that you are buying a non-returnable digital good and waive any right of withdrawal.
5.4 Merchant of Record
Our order process for the digital assets is conducted by our online reseller [insert name]. The reseller is the Merchant of Record for all orders. They handle all customer service inquiries and returns.
6. Customer Data and Privacy
6.1 No Sensitive Data
You agree not to upload, input, or otherwise provide any protected health information under HIPAA, or any other sensitive categories of data (such as financial account numbers, government identifiers, or biometric data). Our Services are not designed to handle that type of data, and we disclaim all responsibility if you choose to submit it.
6.2 Use of Third-Party AI Services
The Services utilize third-party artificial intelligence systems, including Lovable Cloud (powered by Supabase for data storage and backend services), Lovable AI Gateway, and Google Gemini AI models, to generate AI Output in response to your queries. By using the Services, you consent to the transmission of your inputs and prompts to these third-party systems for processing.
Important Privacy Commitment:
We DO NOT use your individual chat queries, conversations, or project-specific details to train our AI models or make them available to other users. Your specific questions and the context you provide remain private to you.
6.3 Anonymized Aggregate Learning
To improve the quality and relevance of Archaster AI for all users, we may use anonymized and aggregated usage patterns derived from Customer Data. This enables us to:
- Understand common query patterns (e.g., "80% of architects ask about passive cooling strategies");
- Build better knowledge bases focused on regenerative design principles;
- Train retrieval systems on anonymized question-answer pairs;
- Create recommendation engines (e.g., "Users who asked X also found Y helpful");
- Improve the accuracy and helpfulness of AI responses to common topics in sustainable design.
What we do NOT do:
- Use your specific project details or identifiable information;
- Identify individuals or organizations from aggregated data;
- Sell aggregated or anonymized data to third parties;
- Share data with competitors or use it to train competitor models;
- Re-identify anonymized data or attempt to link it back to individual users.
Enterprise Opt-Out: Organizations with specific data handling requirements may request to opt out of anonymized aggregate learning. Contact us at privacy@archasterlabs.earth for more information.
6.4 Rights in Customer Data
Subject to Section 6.3 (Anonymized Aggregate Learning), you retain all ownership rights in your Customer Data. We will not sell, license, or share your Customer Data with third parties except as necessary to provide the Services or as required by law.
6.5 Use of PII
We will not use raw or identifiable PII for model training or aggregate learning. We do not sell PII and we do not share it with third parties for advertising or marketing. However, we may anonymize and aggregate PII, and once anonymized and aggregated in a way that cannot be re-identified, we may use it for the purposes set out in Section 6.3.
6.6 Retention and Deletion
Registered Users:
Conversation data is retained in our production systems as long as your account remains active.
Upon account deletion, your data is removed from production systems within 30 days.
Backup copies may persist for up to 90 days before being permanently deleted.
You may delete individual conversations at any time through your account settings. Deleted conversations are removed from production systems immediately and from backups within 90 days.
Guest Users:
Guest conversation data is stored locally in your browser only and is not linked to a user account.
Guest messages are transmitted to our edge functions solely for the purpose of generating AI responses, but are not persistently stored in our database.
AI providers (such as Google Gemini) may process guest prompts transiently according to their own retention policies (typically ≤30 days for logging, security, and abuse prevention).
Clearing your browser storage will delete all locally stored guest conversation data immediately.
Guest mode usage is limited, including reduced query limits (maximum 4 queries), and some features may not be available.
6.7 Customer Responsibility
You are responsible for ensuring that your use of the Services, including any data you submit, complies with applicable data protection and privacy laws.
7. Query Limits and Fair Use
7.1 Guest User Limits
Guest Users are subject to daily query limits to ensure fair access and prevent abuse. These limits are tracked via browser storage and device fingerprinting. Limits reset every 24 hours.
7.2 Registered User Limits
Registered Users have higher query limits based on their subscription tier. We reserve the right to implement rate limiting or usage caps to ensure system stability and fair access for all users.
7.3 Fair Use Policy
We expect all users to use the Services in good faith and in a manner that does not negatively impact other users. Excessive or abusive usage, including automated querying or attempts to circumvent rate limits, may result in temporary or permanent suspension of access.
8. Service Dependencies and Disclaimers
8.1 Third-Party Dependencies
The Services rely on third-party infrastructure and AI providers, including:
- Lovable Cloud (powered by Supabase) for backend infrastructure, database, and storage;
- Lovable AI Gateway for AI model access;
- Google Gemini for natural language processing and AI Output generation;
- Cloudflare Turnstile for bot protection and security.
Because we do not fully control these third-party providers, we cannot guarantee uninterrupted availability, performance, or security of the Services. You understand and agree that interruptions, delays, or errors may occur, and that we will not be responsible for issues caused by those providers or by events beyond our reasonable control (including force majeure events).
8.2 AI Output Disclaimer
AI Output may contain errors, inaccuracies, outdated information, or other issues and should not be relied upon without independent review and verification. You are solely responsible for reviewing, validating, and using any AI Output. You assume full responsibility for your use of AI Output and agree not to rely on it for critical or high-risk functions (including medical, legal, financial, or safety-related purposes) without appropriate safeguards and professional consultation.
AI Output may be similar or identical to content generated for other users who submit similar prompts. We do not guarantee that AI Output will be unique, free of third-party rights, accurate, or suitable for any particular purpose.
8.3 No Warranties
THE SERVICES (INCLUDING ALL AI OUTPUT) ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE AND OUR LICENSORS AND PROVIDERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES OR ANY RESULTS YOU MAY OBTAIN. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL CODE, OR THAT AI OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR INTENDED USE.
8.4 Beta and Experimental Features
From time to time, we may make features available that are identified as beta, preview, or experimental. Such features:
- May be incomplete or subject to significant changes;
- May be discontinued at any time without notice;
- Are provided "AS IS" without any warranties;
- May not be fully tested or stable;
- May be subject to additional terms or limitations.
You use beta and experimental features at your own risk and should not rely on them for production or mission-critical purposes.
9. Suspension and Termination
9.1 Termination by You
You may terminate your account and stop using the Services at any time. For Registered Users, you may delete your account through your account settings. Upon termination:
- Your access to the Services will end immediately;
- Your data will be handled according to Section 6.6 (Retention and Deletion);
- Individual chat conversations will be removed from production systems immediately and from backups within 90 days;
- Account-level data will be removed from production systems within 30 days and from backups within 90 days.
9.2 Termination or Suspension by Us
We may suspend or terminate your account, access to the Services, or any portion of them immediately if we reasonably believe you have:
- Violated these Terms (including the License Restrictions in Section 5);
- Engaged in fraudulent, abusive, or unlawful activity;
- Exceeded fair use limits or engaged in excessive automated querying;
- Uploaded harmful, illegal, or infringing content.
We may also terminate or suspend the Services for convenience by providing you with advance notice. Suspension or termination does not limit any other remedies available to us under law or equity.
9.3 Effect of Termination
Upon termination, your right to access the Services ends immediately. You remain responsible for any obligations that arose before termination. Any provisions of these Terms that, by their nature, should survive termination (including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law) will continue in effect.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR LICENSORS, PROVIDERS, AFFILIATES, AND OFFICERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, WE WILL NOT BE LIABLE FOR:
- Any downtime, failures, delays, or other issues caused by third-party providers (including Lovable Cloud, Supabase, Google Gemini, or any other infrastructure or AI providers);
- Errors, inaccuracies, or limitations in AI Output;
- Any act or omission by you, your users, or anyone using your account;
- Loss of Customer Data, except to the extent caused by our gross negligence or willful misconduct.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID US ANYTHING, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- Your misuse of the Services or violation of these Terms;
- Your failure to comply with applicable laws or regulations;
- Your violation of the terms of any third-party provider (including Lovable Cloud, Supabase, Google, or Cloudflare);
- Any content or Customer Data you provide, including claims of infringement, misappropriation, or violation of third-party rights;
- Your use of AI Output in high-risk contexts without appropriate safeguards.
12. Export Controls and Sanctions
Export Controls and Sanctions
You may not use the Services if you are located in, or acting on behalf of, a person or entity that is subject to European Union, United States, or United Kingdom sanctions or other applicable export-control restrictions. This includes, but is not limited to, users located in:
Cuba
Iran
North Korea
Syria
The Crimea, Donetsk, and Luhansk regions of Ukraine
Any other jurisdiction subject to comprehensive sanctions under EU, US, or UK law
You also may not use the Services if you are listed on any applicable sanctions or restricted-party list, including:
the EU Consolidated Sanctions List
the U.S. Specially Designated Nationals (SDN) List
the U.S. Denied Persons List
the UK Sanctions List
By using the Services, you represent and warrant that you are not subject to such restrictions and will comply with all applicable export-control and sanctions laws.
13. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or relating to them, the Services, or your use of the Services will be governed by and construed under the laws of Norway. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway. , without regard to its conflict of law principles.
Any dispute with us must be brought on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and Archaster each waive any right to a jury trial in any legal proceeding arising out of or related to these Terms or the Services.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings (whether written or oral) relating to the Services.
14.2 Assignment
You may not assign, delegate, or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign, delegate, or transfer these Terms, in whole or in part, without restriction. Any attempt to assign in violation of this section is void.
14.3 Waiver and Severability
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.4 Notices
We may provide notices to you (including changes to these Terms, updates to our Services, or other important information) by email to the address associated with your account, through in-app notifications, or by posting on our website. Notices are deemed given when sent.

14.5 Survival
The provisions of these Terms relating to intellectual property, data rights, disclaimers, limitations of liability, indemnification, governing law, and any other terms that by their nature should survive, will continue in effect after termination of your account or these Terms.

By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of a company or other entity, you further represent that you have authority to bind that entity to these Terms.
3.2 Guest vs. Registered Users
Guest Users: You may use the Services without creating an account, subject to daily query limits. Guest usage is tracked via browser storage. Guest conversations are stored locally in your browser only and are not linked to any account. Guest messages are transmitted to our edge functions for AI processing but are not stored in our database. Clearing your browser data will delete all guest conversations.
Registered Users: By creating an account, you gain access to additional features, including conversation history, saved contexts, and higher query limits. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Intellectual property rights
4. Intellectual Property, Ownership and Licensing
4.1 Our Rights (Archaster Materials)
We (and our licensors) own all rights, title, and interest in and to the Services and Archaster Materials, including all underlying software, infrastructure, technology, databases, APIs, models, algorithms, interfaces, tools, documentation, website designs, text, graphics, and all improvements, modifications, or derivative works of the foregoing.
For the purposes of these Terms:
“Content” means all text, graphics, interfaces, information, and other content made available through the Services.
“Marks” means our trademarks, service marks, logos, and branding used in connection with the Services.
“Archaster Materials” means the Services, the Content, the Marks, and all related technology, designs, and know-how.
Except for the limited license we grant you under these Terms, we reserve all rights in and to the Services and Archaster Materials.
4.2 Your Rights (Customer Data and AI Output)
As between you and us:
Customer Data (data, prompts, uploads, and other content you or your users submit to the Services) remains yours.
Subject to the anonymized and aggregated learning described in Section 6.3, you also own any AI Output generated for you through the Services, to the extent permitted by applicable law and subject to any third-party rights in the underlying models, training data, or outputs.
You are responsible for how you use AI Output, including ensuring that your use complies with applicable law and does not infringe third-party rights.
4.3 Usage Data
We own all Usage Data, meaning anonymized and/or aggregated data and analytics relating to access, usage patterns, and performance of the Services, provided that it does not identify you or your users as specific individuals or organizations. We may use Usage Data for any business purpose as described in Section 6.3.
4.4 Feedback
If you provide us with any feedback, suggestions, ideas, or other information relating to the Services or our business (“Feedback”), you agree that we may use, copy, modify, distribute, publish, or otherwise exploit that Feedback for any purpose, in any form, and through any medium, without restriction or compensation to you. We have no obligation to keep Feedback confidential.
4.5 Your License to Use the Services
Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to:
access and use the Services; and
download or print a copy of any Content to which you have lawfully gained access,
solely for your personal or internal business purposes.
This license does not give you any ownership interest in the Services or Archaster Materials, and all rights not expressly granted are reserved by us and our licensors. This license terminates automatically if you materially breach these Terms or if your account is suspended or terminated for any reason.
4.6 Prohibited Use (Commercial Exploitation)
No part of the Services, Content, or Archaster Materials may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose (for example, reselling our blueprints or derivative works based primarily on them) without our express prior written permission.
4.7 License Restrictions
You agree not to, and not to permit any third party to:
copy, modify, distribute, sell, lease, sublicense, or otherwise exploit the Services or Archaster Materials except as expressly permitted in these Terms;
resell, provide, or make the Services available to any third party on a service bureau, shared, or time-sharing basis;
share your account credentials or allow any unauthorized person to access your account;
reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or algorithms underlying the Services, except to the limited extent that applicable law expressly permits despite this restriction;
bypass, disable, or interfere with any security, usage, rate-limiting, or access controls applied to the Services;
use automated tools (such as bots, scrapers, or crawlers) to access or interact with the Services without our prior written permission;
upload, transmit, or distribute any malicious code, viruses, or other harmful content;
overload, disrupt, or interfere with the normal operation or integrity of the Services or related systems;
use the Services to harass, defame, impersonate, or otherwise harm any individual or organization;
use the Services in violation of any applicable laws, regulations, export controls, or sanctions;
use the Services to generate or disseminate harmful, misleading, unlawful, or infringing content;
misrepresent AI Output as human-generated in contexts where doing so could cause harm, deception, or a material misunderstanding;
rely on AI Output without appropriate review in high-risk or sensitive contexts (including medical, legal, financial, or safety-critical uses), or represent AI Output as professional advice;
extract, reconstruct, or attempt to determine model weights, training data, or system logic underlying the Services;
use the Services, AI Output, or prompts to train, develop, or improve competing AI models or services without our express prior written permission.
5. Purchase of Digital Products & Reports
In addition to the SaaS Platform, we sell standalone digital assets ("Blueprints") and customized reports ("Assessments"). The following terms apply specifically to these purchases:
5.1 Nature of Digital Products
Blueprints: These are static digital downloads. You are purchasing a non-exclusive, non-transferable license to use the content for internal business purposes. You may not resell, republish, or distribute these files.
AI Reports: These are customized data files generated based on your inputs. They are provided "as is" for decision support and do not constitute professional consulting or legal advice.
Data Handling: These reports operate on a "Process & Purge" basis. To ensure maximum security for your trade secrets, Archaster Labs does not retain your submitted data after the report is delivered. You are responsible for saving your own copy of the final report.
5.2 Delivery Policy
Instant Downloads: Delivered via email link immediately upon successful payment.
Custom Reports/Assessments: Delivered via email within ~72 business hours of successful data submission.
5.3 Refund Policy (Strict)
Due to the digital nature of these products:
All sales of Blueprints and Reports/Assessments are final.
We do not offer refunds once the download link has been sent or the data processing has begun.
By completing a purchase, you acknowledge that you are buying a non-returnable digital good and waive any right of withdrawal.
5.4 Merchant of Record
Our order process for the digital assets is conducted by our online reseller [insert name]. The reseller is the Merchant of Record for all orders. They handle all customer service inquiries and returns.
6. Customer Data and Privacy
6.1 No Sensitive Data
You agree not to upload, input, or otherwise provide any protected health information under HIPAA, or any other sensitive categories of data (such as financial account numbers, government identifiers, or biometric data). Our Services are not designed to handle that type of data, and we disclaim all responsibility if you choose to submit it.
6.2 Use of Third-Party AI Services
The Services utilize third-party artificial intelligence systems, including Lovable Cloud (powered by Supabase for data storage and backend services), Lovable AI Gateway, and Google Gemini AI models, to generate AI Output in response to your queries. By using the Services, you consent to the transmission of your inputs and prompts to these third-party systems for processing.
Important Privacy Commitment:
We DO NOT use your individual chat queries, conversations, or project-specific details to train our AI models or make them available to other users. Your specific questions and the context you provide remain private to you.
6.3 Anonymized Aggregate Learning
To improve the quality and relevance of Archaster AI for all users, we may use anonymized and aggregated usage patterns derived from Customer Data. This enables us to:
- Understand common query patterns (e.g., "80% of architects ask about passive cooling strategies");
- Build better knowledge bases focused on regenerative design principles;
- Train retrieval systems on anonymized question-answer pairs;
- Create recommendation engines (e.g., "Users who asked X also found Y helpful");
- Improve the accuracy and helpfulness of AI responses to common topics in sustainable design.
What we do NOT do:
- Use your specific project details or identifiable information;
- Identify individuals or organizations from aggregated data;
- Sell aggregated or anonymized data to third parties;
- Share data with competitors or use it to train competitor models;
- Re-identify anonymized data or attempt to link it back to individual users.
Enterprise Opt-Out: Organizations with specific data handling requirements may request to opt out of anonymized aggregate learning. Contact us at privacy@archasterlabs.earth for more information.
6.4 Rights in Customer Data
Subject to Section 6.3 (Anonymized Aggregate Learning), you retain all ownership rights in your Customer Data. We will not sell, license, or share your Customer Data with third parties except as necessary to provide the Services or as required by law.
6.5 Use of PII
We will not use raw or identifiable PII for model training or aggregate learning. We do not sell PII and we do not share it with third parties for advertising or marketing. However, we may anonymize and aggregate PII, and once anonymized and aggregated in a way that cannot be re-identified, we may use it for the purposes set out in Section 6.3.
6.6 Retention and Deletion
Registered Users:
Conversation data is retained in our production systems as long as your account remains active.
Upon account deletion, your data is removed from production systems within 30 days.
Backup copies may persist for up to 90 days before being permanently deleted.
You may delete individual conversations at any time through your account settings. Deleted conversations are removed from production systems immediately and from backups within 90 days.
Guest Users:
Guest conversation data is stored locally in your browser only and is not linked to a user account.
Guest messages are transmitted to our edge functions solely for the purpose of generating AI responses, but are not persistently stored in our database.
AI providers (such as Google Gemini) may process guest prompts transiently according to their own retention policies (typically ≤30 days for logging, security, and abuse prevention).
Clearing your browser storage will delete all locally stored guest conversation data immediately.
Guest mode usage is limited, including reduced query limits (maximum 4 queries), and some features may not be available.
6.7 Customer Responsibility
You are responsible for ensuring that your use of the Services, including any data you submit, complies with applicable data protection and privacy laws.
7. Query Limits and Fair Use
7.1 Guest User Limits
Guest Users are subject to daily query limits to ensure fair access and prevent abuse. These limits are tracked via browser storage and device fingerprinting. Limits reset every 24 hours.
7.2 Registered User Limits
Registered Users have higher query limits based on their subscription tier. We reserve the right to implement rate limiting or usage caps to ensure system stability and fair access for all users.
7.3 Fair Use Policy
We expect all users to use the Services in good faith and in a manner that does not negatively impact other users. Excessive or abusive usage, including automated querying or attempts to circumvent rate limits, may result in temporary or permanent suspension of access.
8. Service Dependencies and Disclaimers
8.1 Third-Party Dependencies
The Services rely on third-party infrastructure and AI providers, including:
- Lovable Cloud (powered by Supabase) for backend infrastructure, database, and storage;
- Lovable AI Gateway for AI model access;
- Google Gemini for natural language processing and AI Output generation;
- Cloudflare Turnstile for bot protection and security.
Because we do not fully control these third-party providers, we cannot guarantee uninterrupted availability, performance, or security of the Services. You understand and agree that interruptions, delays, or errors may occur, and that we will not be responsible for issues caused by those providers or by events beyond our reasonable control (including force majeure events).
8.2 AI Output Disclaimer
AI Output may contain errors, inaccuracies, outdated information, or other issues and should not be relied upon without independent review and verification. You are solely responsible for reviewing, validating, and using any AI Output. You assume full responsibility for your use of AI Output and agree not to rely on it for critical or high-risk functions (including medical, legal, financial, or safety-related purposes) without appropriate safeguards and professional consultation.
AI Output may be similar or identical to content generated for other users who submit similar prompts. We do not guarantee that AI Output will be unique, free of third-party rights, accurate, or suitable for any particular purpose.
8.3 No Warranties
THE SERVICES (INCLUDING ALL AI OUTPUT) ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE AND OUR LICENSORS AND PROVIDERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES OR ANY RESULTS YOU MAY OBTAIN. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL CODE, OR THAT AI OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR INTENDED USE.
8.4 Beta and Experimental Features
From time to time, we may make features available that are identified as beta, preview, or experimental. Such features:
- May be incomplete or subject to significant changes;
- May be discontinued at any time without notice;
- Are provided "AS IS" without any warranties;
- May not be fully tested or stable;
- May be subject to additional terms or limitations.
You use beta and experimental features at your own risk and should not rely on them for production or mission-critical purposes.
9. Suspension and Termination
9.1 Termination by You
You may terminate your account and stop using the Services at any time. For Registered Users, you may delete your account through your account settings. Upon termination:
- Your access to the Services will end immediately;
- Your data will be handled according to Section 6.6 (Retention and Deletion);
- Individual chat conversations will be removed from production systems immediately and from backups within 90 days;
- Account-level data will be removed from production systems within 30 days and from backups within 90 days.
9.2 Termination or Suspension by Us
We may suspend or terminate your account, access to the Services, or any portion of them immediately if we reasonably believe you have:
- Violated these Terms (including the License Restrictions in Section 5);
- Engaged in fraudulent, abusive, or unlawful activity;
- Exceeded fair use limits or engaged in excessive automated querying;
- Uploaded harmful, illegal, or infringing content.
We may also terminate or suspend the Services for convenience by providing you with advance notice. Suspension or termination does not limit any other remedies available to us under law or equity.
9.3 Effect of Termination
Upon termination, your right to access the Services ends immediately. You remain responsible for any obligations that arose before termination. Any provisions of these Terms that, by their nature, should survive termination (including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law) will continue in effect.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR LICENSORS, PROVIDERS, AFFILIATES, AND OFFICERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, WE WILL NOT BE LIABLE FOR:
- Any downtime, failures, delays, or other issues caused by third-party providers (including Lovable Cloud, Supabase, Google Gemini, or any other infrastructure or AI providers);
- Errors, inaccuracies, or limitations in AI Output;
- Any act or omission by you, your users, or anyone using your account;
- Loss of Customer Data, except to the extent caused by our gross negligence or willful misconduct.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID US ANYTHING, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- Your misuse of the Services or violation of these Terms;
- Your failure to comply with applicable laws or regulations;
- Your violation of the terms of any third-party provider (including Lovable Cloud, Supabase, Google, or Cloudflare);
- Any content or Customer Data you provide, including claims of infringement, misappropriation, or violation of third-party rights;
- Your use of AI Output in high-risk contexts without appropriate safeguards.
12. Export Controls and Sanctions
Export Controls and Sanctions
You may not use the Services if you are located in, or acting on behalf of, a person or entity that is subject to European Union, United States, or United Kingdom sanctions or other applicable export-control restrictions. This includes, but is not limited to, users located in:
Cuba
Iran
North Korea
Syria
The Crimea, Donetsk, and Luhansk regions of Ukraine
Any other jurisdiction subject to comprehensive sanctions under EU, US, or UK law
You also may not use the Services if you are listed on any applicable sanctions or restricted-party list, including:
the EU Consolidated Sanctions List
the U.S. Specially Designated Nationals (SDN) List
the U.S. Denied Persons List
the UK Sanctions List
By using the Services, you represent and warrant that you are not subject to such restrictions and will comply with all applicable export-control and sanctions laws.
13. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or relating to them, the Services, or your use of the Services will be governed by and construed under the laws of Norway. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway. , without regard to its conflict of law principles.
Any dispute with us must be brought on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and Archaster each waive any right to a jury trial in any legal proceeding arising out of or related to these Terms or the Services.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings (whether written or oral) relating to the Services.
14.2 Assignment
You may not assign, delegate, or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign, delegate, or transfer these Terms, in whole or in part, without restriction. Any attempt to assign in violation of this section is void.
14.3 Waiver and Severability
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.4 Notices
We may provide notices to you (including changes to these Terms, updates to our Services, or other important information) by email to the address associated with your account, through in-app notifications, or by posting on our website. Notices are deemed given when sent.

14.5 Survival
The provisions of these Terms relating to intellectual property, data rights, disclaimers, limitations of liability, indemnification, governing law, and any other terms that by their nature should survive, will continue in effect after termination of your account or these Terms.
